TAYALI SURVIVES DEFAMATION OF PRESIDENT

The state has entered a nolle prosequi in a matter where Economic and Equity Party President CHILUFYA TAYALI was charged with defamation of the President.

Mr. TAYALI was indicted for allegedly defaming former President EDGAR LUNGU.

He was arrested in May 2021.

This was pursuant to a video that went viral on social media where Mr. TAYALI made derogatory remarks against former President LUNGU.

The matter was before Lusaka Resident Magistrate ALICE WALUSIKU.

Defamation of the President is an offence contrary to section 69 of the Penal Code Chapter 87 of the Laws of Zambia.

Meanwhile plea in a matter where Patriotic Front-PF Chairperson for Information and Publicity RAPHAEL NAKACINDA is charged with defamation of the President has failed to take off today.

This is on account that the indictment was not available in court.

Mr. NAKACINDA was arrested and charged with defamation of President HAKAINDE HICHILEMA few days ago.

This follows his remarks that President HAKAINDE HICHILEMA was coercing judges over the determination of the matter pertaining to the eight PF members of Parliament whose election results have been nullified by the High Court.

The case of the eight MPs which has been withdrawn from the High Court was centered on Judicial Review of the decision by Speaker of the National Assembly NELLY MUTTI to eject them from attending the business of the house.

On the other hand, nine PF members of Parliament whose election results have been nullified by the High Court in various jurisdictions have their appeals still pending determination in the Constitutional Court.
