SPEAKER BANS 9 MPS FROM PARLIAMENT

All the nine Members of Parliament whose elections were nullified by the high court have been told not to take part in any Parliamentary business until their appeals are determined by the Constitutional Court.

Speaker of the National Assembly NELLY MUTTI says only those who will be successful in their appeals in the Constitutional Court will be allowed back in the house.

The MPs’ whose elections were nullified are from KABUSHI, CHIMWEMWE. LUNTE, NAKONDE, CHINSALI, KASAMA, KWACHA, MKUSHI NORTH, and LUBANSENSHI Constituencies.

Ms MUTTI who delivered a ruling today following a point of order raised by Solwezi East  Member of Parliament ALEX KATAKWE.

Dr KATAKWE raised concern regarding the continued attendance of sittings of the house by BOWMAN LUSAMBO despite the nullification of his election as KABUSHI Member of Parliament by the High Court.

Mr LUSAMBO’s election was petitioned by UPND losing Kabushi candidate in the 2021 General election BERNARD KANENGO.

Mr LUSAMBO’s election was subsequently nullified by the High Court.

On 22nd November, 2021, Mr LUSAMBO appealed against the High Court’s decision to the Constitutional Court and the matter is YET to be heard.

The Speaker in her rolling stated that the determination of a petition as envisaged in Article 73 chapter 4 of the Constitution is the determination by the High Court, which applies to situations where an aggrieved party appeals or does not appeal to the Constitutional Court.

Ms MUTTI explained that she has considered the view that Mr LUSAMBO, the Member of Parliament is out of order to remain in the house after the nullification of his election by the High Court.
