MALANJI, LUSAMBO to know their fate tomorrow

The Constitutional Court is tomorrow expected to hand down judgment in a matter where BOWMAN LUSAMBO and JOSEPH MALANJI have sought constitutional interpretation over their disqualification from contesting parliamentary by-elections on the Copperbelt.

The panel of five judges headed by Constitutional Court Deputy President MARGARET MUNALULA reserved tomorrow for judgment after hearing oral arguments from the State, Electoral Commission of Zambia (ECZ) and lawyers representing Mr. LUSAMBO and Mr. MALANJI.

Making submissions, the Attorney General Chambers asked the court to dismiss the matter.

Attorney MULILO KABESHA has argued that the Originating Summon is a wrong mode of seeking relief in the matter filed by Mr. LUSAMBO and Mr. MALANJI.

On the other hand Solicitor General MARSHALL MUCHENDE reiterated that the matter must be entirely dismissed as it is not properly before the Constitutional Court on account of a wrong mode of commencement.

However Lawyers MAKEBI ZULU, TUTWA NGULUBE and JONAS ZIMBA who are representing Mr. MALANJI and Mr. LUSAMBO made counter arguments.

Mr. ZULU asked the court to make a proper distinction between what entails disqualifications and nullification.
