HIGH COURT RESERVES RULING IN MALANJI,LUSAMBO CASE

By Hannock Kasama

The LUSAKA High Court has reserved ruling in a matter where former KWACHA Member of Parliament JOSEPH MALANJI and his KABUSHI counterpart BOWMAN LUSAMBO have asked the Court to suspend the September 15th by-elections in their constituencies.

The ruling will be made tomorrow Tuesday , September 13, 2022.

In the affidavit before the court Mr. MALANJI and Mr. LUSAMBO have claimed that they would suffer prejudice unless the parliamentary polls are suspended.

They have also argued that the petition where they have challenged the jurisdiction of the ECZ’s returning officer to reject their nomination papers might not be heard before the September 15, 2022 parliamentary by-elections.

During the hearing in chambers, the state was represented by Solicitor General MARSHALL MUCHENDE and Chief State Advocate JOE SIMACHELA.

Mr. MALANJI and Mr. LUSAMBO were represented by LUSAKA Lawyers MAKEBI ZULU, JONAS ZIMBA and TUTWA NGULUBE among others while the ECZ was represented by its in house lawyer.
