GOVT DRAGGED TO COURT OVER COVID-19 VACCINATIONS

Government has been dragged to court over the announcement that only vaccinated people against COVID-19 should be allowed to access government buildings.

Lusaka Lawyer KELVIN ZIMBA of MOSHA and Company has filed the petition in the Lusaka High Court.

Mr. ZIMBA of House Number 07, MUCHENJA Street, Lusaka’s Chelston area seeks the High Court’s declaration that the announcement made by Health Minister SILVIA MASEBO is void and of no effect.

He has also sought the Court’s certiorari to quash the announcement.

Mr. ZIMBA has sued Mrs. MASEBO as second defendant while the Attorney General is the first defendant in the matter.

He says the announcement by Mrs. MASEBO that unvaccinated individuals would not access government buildings or place of work is discriminatory and an affront to human rights.

Mr. ZIMBA argues that the decision contravenes articles 13, 19, 21 and 23 of the Republican Constitution.

He has further alleged that government has not consulted labour Unions’ representatives over the COVID-19 vaccinations but merely informed them of punitive measures against those that would not comply.

This is according to the petition filed in the Lusaka High Court.

On November 28, 2021 Health Minister SILVIA MASEBO announced government’s reinforcement of measures against COVID-19.

Among the measures Mrs. MASEBO said the unvaccinated individuals would not be allowed to access government buildings and places of work.
