GEARS PETITIONS AGAINST ‘NULLIFIED’ MPS BUT STILL IN PARLY

Governance and Elections Advocacy Research Service Initiative -GEARS- Zambia Limited has petitioned those whose parliamentary election results have been nullified not to attend the National Assembly’s proceedings.

Executive Director MCDONALD CHIPENZI has filed the petition in the LUSAKA High Court against nine individuals whose parliamentary election results have been nullified but still attending the National Assembly’s proceedings.

Mr. CHIPENZI has contended that the availability of the nine in parliamentary proceedings is an affront to article 68 sub-article one, article 72 sub-article two and article 73 sub article four of the constitution.

He also contends that the practice contravenes the provisions of the Electoral Process Act.

Recently, the High Court in various jurisdictions nullified the election BOWMAN LUSAMBO of KABUSHI, JOSEPH MALANJI of KWACHA, MUTOTWE KAFWAYA of LUNTE and SIBONGILE MWAMBA of KASAMA Central constituencies.

Others whose elections were nullified are LUKA SIMUMBA of NAKONDE ALLEN BANDA of CHIMWEMWE , KABWE TAULO CHEWE of LUBANSENSHI , KALALWE MUKOSA of CHINSALI and CHRISTOPHER CHIBUYE of MUCHINGA constituencies.

However the respondents have continued attending the business of the National Assembly having appealed to the Constitutional Court.
