DPP Amenable – ConCourt

The Constitutional Court has ruled that the Director of Public Prosecutions -DPP- is subject to the disciplinary procedure of the Judicial Complaints Commission -JCC.

This is in a matter where LUSAKA Lawyer, JONAS ZIMBA asked the Constitutional Court to interpret whether being a non-judicial officer, the DPP can be subjected to the procedure under the Judicial Code Act.

Mr. ZIMBA also sought clarification on whether the Constitution confers the JCC jurisdiction to try the DPP.

But the Court has cited the case of MUTEMBO NCHITO versus the attorney General as one of the precedents.

The Court has further ruled that the DPP can be removed from office on grounds applicable to Judges as stated by article 182 sub-article three of the Constitution.

Mr. ZIMBA was being represented by LUSAKA Lawyer JOSEPH CHIRWA of the FERD JERE and Company, while Solicitor General MARSHAL MUCHENDE and other State Advocates stood for the State.
