Concourt declares Chimwemwe MP duly elected

Hannock Kasama-The Constitutional Court has declared ALLEN BANDA as duly elected Member of Parliament for CHIMWEMWE Constituency.

The Court has set aside the KITWE High Court’s judgment that invalidated the election results of Mr. BANDA of the Patriotic Front- PF.

Mr. BANDA appealed to the Constitutional Court having been dissatisfied with the decision of the KITWE High Court to nullify his election victory following the petition by MATANDA of the United Party for National Development-UPND.

He raised five grounds of appeal.

The Constitutional Court has ruled that non-compliance with Regulation 43 of the Electoral Process Act in the conduct of the CHIMWEMWE Parliamentary polls did not entirely compromise the outcome of the results.

The court has further established that election results can only be set aside if the polls were held in defiance with Section 97 Sub-Section two of the electoral process.

And speaking after the Judgment Mr. BANDA thanked the judiciary and pledged to work hard to improve the lives of his people.
