SYDNEY CHOSE  DULY ELECTED-COURT

The Constitutional Court has declared SYDNEY CHOSE as duly elected Councilor of CHINGOMBE Ward in LUANO district during the 2021 General Election.

The Court has reversed the Local Election Tribunal’s verdict to nullify the election victory of Mr. CHOSE of the Patriotic Front -PF.

The Constitutional Court made the verdict following the petition by Mr. BONIFACE KAITANO of the United Party for National Development-UPND who was Mr .CHOSE’s closest rival.

Mr. CHOSE polled 5-hundred and 92 votes while Mr .KATAINO accumulated 4-hundred and 4 votes.

However Mr. KAITANO petitioned the results contending the elections were marred with bribery and usage of government resources during campaigns.

Mr. KAITANO argued that the election was not free and fair.

Dissatisfied with the Local Election Tribunal’s verdict, Mr CHOSE appealed to the Constitutional Court and raised six grounds of appeal.

Among the grounds, Mr .CHOSE contended that Mr. KAITANO did not prove the allegations of electoral malpractices to the highest degree of standard of proof.

Mr .CHOSE made the submissions through LUSAKA Lawyer KENNEDY KAUNDA of KAUNDA KAUNDA Legal Practitioners while Mr. KAITANO represented himself.

Constitutional Court Judges ANNIE SITALI, CHRISTINE MUNALULA, PALAN MULONDA, MARTIN MUSALUKE and JUDY MULONGOTI presided over the appeal.
