Notorious Chingola Gangster Convicted for Defilement

The Chingola Magistrate Court has convicted and committed to the Kitwe High Court Victor Phiri a gang leader commonly known as C4 for sentencing in a matter he is charged with two counts of defilement.

C4, who was in August committed to the Kitwe High Court for another set of crimes of Murder and attempted murder for sentencing has been convicted after being found guilty of defilement.

Facts before court are that on 9th and 10th August 2017 the accused had carnal knowledge of the minor without her consent contrary to the Laws of Zambia.

The accused had pleaded not guilty to the charge.

After being placed on defence following trial, the accused admitted having had carnal knowledge of the minor contending that juvenile told him she was 17 years.

In delivering his Judgment Magistrate Kalutwe Chiluba said the prosecution had proved the case beyond reasonable doubt and that he was satisfied with the evidence presented before court.

“In collaboration with the evidence before court the minor was a child and the accused was not married to her but whether she was his girlfriend or not the minor was defiled therefore I find you guilty of both counts and convict you accordingly,” he said.
