MILINGO LUNGU loses stay of execution bid

The Lusaka High Court has refused to grant an application by Former Konkola Copper Mines –KCM- Provisional Liquidator MILINGO LUNGU to stay the execution of a judgment allowing the seizure of his 24 million Kwacha deemed to be proceeds of crimes.

The amount is held in three local commercial banks.

Mr. LUNGU applied to the court to stay the execution of its ruling pending the determination of his appeal in the Court of Appeal.

But the LUSAKA High Court has quashed Mr. LUNGU’s application, saying his appeal will not succeed.

The Court has also ruled that the stay of execution of judgment is not automatic but the discretion of the Court.

The judgment has been delivered by three LUSAKA High Court Judges PIXXIE YANGAILO, IAN MABOLOBOLO and ANNE MALATA-ONONUJO.

Recently, the LUSAKA High Court endorsed the application by Director of Public Prosecutions -DPP- GILBERT PHIRI to seize Mr. LUNGU’s 24 million KWACHA deemed to be proceeds of crime.
