MALANJI FIGHTS FOR KWACHA

Kwacha Member of Parliament JOSEPH MALANJI has asked the Constitutional Court to set aside the High Court verdict to nullify his election.

Mr. MALANJI has submitted that the High Court misdirected itself by not adhering to the provisions of the Electoral Process Act.

He has submitted that the foregoing law requires that allegations of electoral malpractice must be directly linked to the candidate.

Mr. MALANJI further submitted that the court brushed aside his submissions that he has a requisite Grade 12 Certificate that warranted him to contest the Parliamentary Election.

He has submitted that the burden lay on the respondent CHARLES MULENGA to prove that he has no Grade 12 Certificate.

But Mr .MULENGA who was his closest rival in the KWACHA race has submitted that the High Court was on firm ground to nullify Mr. MALANJI’s election victory on account that he allegedly does not have a Grade 12 Certificate.

This is a matter where Mr. MALANJI of the Patriotic Front-PF has appealed in the Constitutional Court against the nullification of his election result as KWACHA Member of Parliament.

The Constitutional Court has set May 5, 2022 for judgment in the matter.
