Magistrate Malumani’s professional misconduct
Dear editor,
Magistrate Greenwell Malumani mislead the nation when he found the incarcerated UPND leader, Hakainde Hichilema, with the case to answer.
The trial judge erred both in fact and law as the public perceived him to have proved the accused guilty of the offence beyond reasonable doubt. This explains why he had the accused put on his defense. However, the accused elected to remain silent.
But when he acquitted HH many proponents of justice have questioned his professional misconduct over the case.
However, notwithstanding the credibility of the witnesses’ evidence tendered against the accused, the Magistrate would have handled the case professionally.
As the eye and ear of the administration of justice, I feel the case was unprofessionally handled by Magistrate Malumani.
