LUBINDA petitions the High Court

Patriotic Front-PF- Vice-President GIVEN LUBINDA has filed a petitioned in the Lusaka High Court, claiming that his right to a fair trial is being violated in the matter where he is charged with possession of properties deemed to be proceeds of crime.

Mr. LUBINDA has disputed the verdict by LUSAKA Magistrate SANDFORD NGOBOLA, sitting in the Financial and Economic Crime Court, not to compel the prosecution to produce the ordinary statement recorded from him before he was charged.

He says Magistrate NGOBOLA has only endorsed the production of selective and exclusive documents by the prosecution as part of evidence.

Mr. LUBINDA says the situation will prevent him from adequately defending himself.

He has cited article 18 sub-article one of the constitution.

Mr. LUBINDA is seeking the High Court’s declaration that the production of selective and exclusive documents by the Prosecution is an infringement of his rights to a fair trial pursuant to articles 18 sub article one of the Constitution.

The PF Vice President was arrested in March, last year.
