KPZ directors warned

….It is contemptuous for KPZ directors to itemize the activities of the mine to their shareholding with the hope of attracting investment to kalengwa mine whose activities were stopped by the court.

Lusaka (04-07-2921) – Retired Senior Assistance Commissioner of Police (ACP) Albert Ngimu has threatened to drag Valden Findlay and other KPZ directors in Zambia to court for contempt if they continue disregarding the directives of the court that stopped all mining activities at Kalengwa mine be halted until the main matter is determined by the competent courts of jurisdiction.

Ngimu who is one of the directors at Euro -Africa Kalengwa mine told journalists that it is contemptuous for KPZ directors to itemize the activities of the mine to their shareholding with the hope of attracting investment to kalengwa mine whose activities were stopped by the court.

Ngimu said he saved the injunction to the people that were found on-site.

He said chief’s representatives on Samora  Kayombo witnessed the handover of the judgement that restored the 2019 injunction that restrained parties the mine from either visiting the mine site or undertaking any form of activities

He said the lawyers for KPZ are equally aware of the existence of a caveat that stop either party from undertaking any activity at the mining site.

While Findley was spotted at Kalengwa Mining site on June 30th 2021 where he was telling workers that he has the authority to do mining activities from the executive, Ngimu, said KPZ directors issued a memo to the shareholders detailing activities and plans to be undertaken at Kalengwa Mine in Mufumbwe districts.

Ngimu feels these activities are not only a deliberate ploy to disregard the court order but also create an impression to the investors that KPZ owns Kalengwa mine when in fact not.

He also expressed surprise that Chanda was accusing the chief of interfering with the mining activities.

He not only denied the chief is delaying the development in the area but also clarified that it was the court that stopped parties from carrying out activities at Kalengwa mine in Mufumbwe.

He said failure to respect the court judgement is a serious offence that leads one to go to prison and if the director for KPZ either by themselves or through their directors fail to obey the court, he will instruct his lawyers to drag them to court for contempt.

He said Zambia is a country of laws and doubt the claims by Findley that he was allowed by the executive are true.

He said the executive could not allow KPZ to operate on Kalengwa mine because doing so would interfering in the work of the judiciary.

The insinuation that the executive gave KPZ a right to do mining activities at kalengwa shows that the Zambian government does not respect its laws.

He said no country in the world would do that because that would scare of investor that has plans to operate in the country.

He said Zambia is a country governed by laws that ought to be respected by everyone including members of the executive.

He said everywhere in the world, the decision of the laws form part of the law and if this law can not be respected then there is a general breakdown in the rule of law which Zambia prophesy.

To stop this rot from going on, we will have no option but to sue KPZ directors to court for contempt and sent to prison all those directors including Findley to court for refusing to honour the court decision which forms part of the law which ought to be respected..

He expressed sadness that total disregard of the court order on account of protection from the executive is the source of anarchy which should not be allowed to mature in Zambia.

He said the test of the court order that restored the 2019 injunction directed that all mining activities including site visits by any one of the warring parties must immediately stop.

He said it is an act of contempt for Findley to claim that he has the authority from the executive to operate at Kalengwa mine using his KPZ company.

It is for this reason why we are warning Findley and the KPZ directors of penal consequences ascribed with contempt and we shall not hesitate to invoke the provisions of the law and drag the culprits to court to show cause why they can not be sent to prison for contempt.

Meanwhile Chief Kizela jas taken offence at wild at made on him by opposition New Congress Party (NCP) president Peter Chanda who alleged that he was sitting on the way of development in his chiefdom.

Chief Kizela told journalists through his son Fumpa that the statement by Chanda that HRH is hindering development in Mufumnwe is not only malicious and regrettable but also lack the relevant facts to make it believable.

He said HRH has always wanted mine to be fully operational for all the people to benefit.

Kizela observed that currently, Mufumbwe has a high number of unemployed youths that would largely benefit once the mine is operationalised.
He said the Royal Establishment awaits for the time when Kalengwa mine will be operational.

He further suggested that the Royal Establishment has always stood by MOXICO that has been helpful to the local people in the area.

For example, Kizela said has not only rebuilt the police stations which was gutted by fire but has assured the community of schools and hospitals but also assured to sponsor youths to higher learning institutions with an assurance of job placements.

He urged the politicians to desist from including traditional leaders in their arguments to gain political mileage.
