Kitwe Businessman Appears in Court over Copper Theft

Incarcerated Kitwe businessman Daniel Makina has finally been brought before the courts of law one month after being arrested for copper theft at gunpoint.

When the mater came up for mention, Makina, through his army of lawyers applied for a preliminary inquiry in the matter where he is charged with aggravated robbery, a non bailable offence contrary to section 294(1) of the penal code chapter 87 of the laws of Zambia.

Makina, who has hired three legal firms to represent him applied that he be heard in the magistrate Court before the matter can go to the High Court arguing that he has overstayed in custody without trail.

Particulars before Court are that, on 28th August, 2018 in Kitwe, Makina and  Chipili Chilufya jointly and whilst acting together with other persons unknown did attack Rehab Bashid Magwila with a fire arm and did use and threatened violence in order to steal the copper cathodes valued at K1.8 million the property of Polytra Zambia limited.

Makina’s lawyers in Mukumbi and Company, Nyirongo and Company as well as Leonard Lane and Partners argued that the delay to put on trial their client is an indication the prosecution is not serious WITH he matter.

However, Magistrate Kampinda Chipamu has reserved ruling on the application to 15th October, 2018.
