Dismiss fertiliser firms’ application-ZPPA

Hannock Kasama-The LUSAKA High Court has been urged to dismiss the application for Judicial Review by four firms over the cancellation of their tenders for the supply, delivery, warehousing and distribution of fertilizer for the 2022-2023 farming season.

This is according to an affidavit in opposition filed in the LUSAKA High Court by The Zambia Public Procurement Authority-ZPPA .

Acting Director Compliance and Monitoring GILBERT MBEWE has submitted that the application has no merit as it does not disclose any arguable case worthy of further consideration during any possible substantive judicial review proceeding.

Mr. MBEWE has also submitted that the decision to terminate the tenders was based on fundamental irregularities observed in the procurement procedures and not the submitted bids.

He has submitted that the termination of tenders was thus not illegal, irrational nor procedurally improper

The firms are Evergreen fertilizer limited, Stoutone Investments limited, Samar Agro investments limited and Conchak Investments limited.

They sued the ZPPA appeals committee and the Procurement Committee in the Ministry of Agriculture.
