Court Throws Out Vedanta Appeal Join ZCCM-IH KCM Liquidation Petition

The Lusaka High Court has declined to allow Vedanta Resources to be joined in a case where ZCCM – IH has petitioned for the winding up of Konkola Copper Mines – KCM.High Court Judge Anessie Banda Bobo says this is because there is no provision that allows Vedanta Resources to be joined to the matter at this stage of the proceedings.Judge BOBO further guided that a non-party who wants to join the winding up petition should file a notice of motion to be heard.In this matter Vedanta Resources had applied to be joined to the proceedings because it is the major shareholder in KCM and that it has enough interest in the mining firm which it seeks to protect.The Company further argued that if not joined to the petition it may suffer losses because of the interest it has in the matter.But this application was opposed both by the petitioner ZCCM – IH and KCM through its liquidator.They told the court that in a winding up petition there is no stage at which a non-party can be joined to the proceedings.They argued that even if Vedanta Resources is a major shareholder it has no right to appear in court as a litigant in the matter.They further said the intended joinder should have instead filed a notice to be heard by the judge.In this matter ZCCM- IH is the petitioner while Konkola Copper Mines is the respondent.
