ConCourt urged to dismiss BOWMAN LUSAMBO’s petition

Attorney General MULILO KABESHA has asked the Constitutional Court to dismiss a petition where former LUSAKA Province Minister BOWMAN LUSAMBO has challenged the legality of the Economic and Financial Crimes Court.

Mr. KABESHA says the petition is ill fated and baseless.

He has countered Mr. LUSAMBO’s contention that the establishment of the Economic and Financial Crimes Court breaches articles 120 and 266 of the Constitution.

Mr. KABESHA has contended that the Economic and Financial Crimes Court has been established administratively like the Gender Based Violence Fast Track Court and Fast Track Traffic Court.

He has made the Submissions today before the Constitutional Court.

But Mr. LUSAMBO has insisted that the establishment of the Economic and Financial Crimes Court breaches articles 120 and 266 of the Constitution.

Mr. LUSAMBO through his lawyer JONAS ZIMBA of MAKEBI ZULU and Company has contended that article 133 sub-article two of the Court has not listed the Economic and Financial Crimes Court as the division of the High Court.

Mr. LUSAMBO’s petition comes on the backdrop of the dismissal of his plea before the LUSAKA High Court in February that the Economic and Financial Crimes Court’s trials must be stopped in a matter where he is charged of possessing properties deemed to be proceed of crime.

Mr. LUSAMBO earlier contended that the establishment of the Economic and Financial Crimes Court is illegal as it does not have a Constitutional backing.
