Concourt to review its decision on Munir Zulu

Hannock Kasama-The Constitutional Court is earmarked to deliver a ruling on whether or not to review its decision not to allow LUMEZI Constituency Member of Parliament, MUNIR ZULU to file heads of arguments out of time, as a respondent in an electoral petition appeal.

The ruling is expected to be delivered on August 18, 2022.

The Court of Original and final jurisdiction on constitutional matters, has reserved the ruling following the application by Mr. ZULU on June 8, 2022.

Earlier, on May 20, 2022 the Constitutional Court had quashed Mr. ZULU’s application to file the heads of arguments out of time and set July 29, 2022 for judgment in the petition appeal.

This was after an objection by an appellant, ZELLIPA CHISULO, through her lawyer BUTLER SITALI.

Ms. CHISULO, who was an Independent candidate in the August 2021 LUMEZI Parliamentary race cited the precedence of MUYAWA LIUWA verses Judicial Complaint Authority and Attorney General of 2011 where it was held that the highest court cannot review its own decisions.

This is in a matter where Ms CHISULO and others have appealed against the High Court’s verdict to uphold the LUMEZI parliamentary election results that saw Mr. ZULU of the Patriotic- PF emerge as a victor.
