ConCourt dismisses HH’s High Court application

The Constitutional Court (ConCourt) this morning, September 2, 2016 dismissed UPND presidential candidate Hakainde Hichilema’s application to have the 14 days matter settled in the High Court.

This in a case in which Hichilema is challenging the validity of the reelection of Edgar Lungu and yesterday filed in a motion requesting the Constitutional Court to refer the matter of the 14 days time frame within which the petition must be heard to the High Court for determination.

The petitioners wanted the Constitutional Court, which is the highest court in the land, to refer the matter to the High Court, an inferior court by legal standards, for determination. The motion has been filed in line with the provisions of Article 28 of the Constitution.

But passing the verdict after hearing the matter the ConCourt dismissed the application saying it is higher than High Court.

The hearing of the petition has continued and will be concluded by end of the day.
