State halts one of Hichilema’s cases

The State this morning, May 10, 2017 halted one of the cases Hakainde Hichilema has been charged with by entering a nolle prosequi.

This is a case where Hichilema the leader of the opposition UPND is charged with disobeying orders to give way to Presidential Motorcade at Limulunga District in the Western province of the Republic of Zambia on April,8th, 2017.

Principle State Advocate Gamaliel Zimba stated he had received instructions to stop the case from the Director of Public Prosecutions for the Republic of Zambia.

The state normally will enter a nolle prosequi if in the process of the case there is no sufficient evidence to prosecute case and the accused could be rearrested anytime.

This is when the matter came up before Magistrate Greenwell Malumani.

In passing ruling, Magistrate Malumani said he has read through the provisions of the law which talks about the powers of the DPP.

He says notwithstanding that HH and five others have been in prison for 30 days, he feels duty bound too but that the Magistrate court has no power to stop the nolle prosequi.

He has ordered that nolle prosequi be continued and that all the accused be discharged.

Magistrate Malumani has since called the court that trial on count 3 which has to do with using insulting language resumes.

By press time the trial on count 3 has begun.
