Six Put on Defence for Criminal Trespass in Chingola

The Chingola Magistrates Court has put six people on their defence after they were found with a case to answer in a matter they are charged with criminal trespass.

This is in a matter Kipispn Nyerenda, 38, James Mulongoti, 41, George Chongo, 55, Malama Bwalya, 28, Bernard Bwalya, 43, all of Kasompe area as well as Bernadette Chileshe, 46 of Kabundi extension.

Particulars of the offence are that the six on 13th September, 2018 whilst acting together with other persons wilfully did enter the property of the Chingola Municipal Council with intent to commit a felony.

When the matter came up for ruling, Chingola Magistrate Shedrick Chanda found the six with a case stating that the prosecution had proved beyond reasonable to establish a prima facie case.

Magistrate Chanda put the six on their defence.

And in presenting their defence, Kipison Nyerenda, explained before court that he had authority from the Mayor and Town Clerk to be on the said piece of land.

He argued that he was on the said piece of land but had no intentions of committing any crime.

Nyerenda brought in one witness Amos Sikamba who told the Court that Nyerenda was among some people who had been appointed by the Local Authority to be reporting any illegalities on the piece of land.

He stated that Nyerenda was not trespassing but was only in charge of reporting to the local authority on any illegalities.

The matter has since been adjourned to 25th October, 2018 for continued defence.
