Notorious Hundreds Boy Found With Case To Answer

The Kitwe Magistrates Court has found a 23-year old man suspected to be a member of the hundreds gang with a case to answer on unlawful wounding and kidnapping charges.

This is in a case where Junipa Gondwe the man who has been found with a case is jointly charged with four other suspected members of the same gang with kidnapping, assault and unlawful wounding, among other charges.

Kitwe magistrate Chongo Musonda has since placed Gondwe on his defence after being satisfied with the evidence presented before the court by the state.

Gondwe, a 16-year old boy, Makelo Mubita, 21, an 18-year old boy and Richard Gondwe 21, are alleged to have wounded Collins Phiri on March 27 this year in Kitwe.

In the second count, 16-year old boy pleaded guilty to the assault charge, while in the third count, Gondwe and Mubita pleaded guilty to assault and were each sentenced to four years imprisonment.

In the fourth count, all the accused persons are charged with kidnapping or abduction which they all denied.

When the matter came up for ruling on Monday, magistrate Musonda acquitted the 18-year old boy and Richard of all the three charges while Mubita was acquitted of unlawful wounding and kidnapping charges.

The 16-year old boy was also acquitted of three charges but he is awaiting judgment in the assault charge count where he pleaded guilty.

 

Magistrate Musonda said the testimonies from the witnesses implicated Junipa to be part of the group that unlawfully wounded and kidnapped Mr Chanda.

During trial, the court heard that the accused was in the company of a group of people on a particular day that attacked and beat Mr Chanda, a footballer as he was waiting for transport en route to a training session.

In his defence Junipa denied being part of the group that kidnapped Mr chanda.

The court adjourned the matter to August 10, 2018 for mention and August 17, 2018 for judgment.

The court also set July 20, 2018 as date for analyzing the social welfare report for the 16-year old boy.
