Lusaka High Court Throws out Application by UPND to Stop President Elect Edgar Lungu’s Inauguration next week

THE LUSAKA HIGH COURT has thrown out an Ex-parte application filed by United Party for National Development (UPND) President Hakainde Hichilema and his Vice-President Geoffrey Bwalya Mwamba in which he sought to restrain the Chief Justice Mrs. Justice Ireen Mambilima and Deputy Chief Justice Mr. Justice Marvin Mwanamwambwa from performing their function of swearing-in President-elect Edgar Chagwa Lungu as scheduled on Tuesday 13th of September 2016.

This comes after Mr. Hichilema took a matter arising from the dismissal of his Presidential election petition by the Constitutional Court on Monday to the High Court. Mr. Hichilema was contesting the re-election of Mr. Lungu and his running-mate Mrs Inonge Wina.
He named the Chief Justice and deputy Chief Justice as Respondents in the matter.

However, when the Matter came up before Judge Chitabo dismissed the ex-parte application and instead ordered an interparty hearing has been set for tomorrow.

The Constitutional Court on Monday dismissed his petition for want of jurisdiction after the constitutional cap of 14 days elapsed in which he could be heard.
