LUO WINS MUNALI ELECTION PETITION

The Constitutional Court has declared Nkandu Luo was dully elected Member of Parliament for Munali constituency.
The Court has set aside the earlier judgement by the Lusaka High Court that nullified Professor Luo’s election victory.
Constitutional Court Judge Enock Mulembe has upheld Professor Luo’s grounds of appeal against the High Court judgement.
Judge Mulembe noted that for an election petition to succeed, the petitioner needs to adduce evidence to the highest standard of proof.
He stated that the standard of proof must be clearly substantiated by those who make an allegation.
Last year, the Lusaka High Court nullified the election of Professor Luo on allegations of electoral malpractices and violence in a petition filed by UPND candidate Doreen Mwamba who was her opponent.
