Lusaka, Zambia24 – (21-05-2024) – Prominent Zambian lawyer Kelvin Fube Bwalya and his co-accused Beauty Chama have been cleared of all charges following a nolle prosequi issued by the Director of Public Prosecutions (DPP), Gilbert Phiri.

The DPP’s decision to discontinue proceedings effectively exonerates the accused. Bwalya and Chama faced charges including money laundering and possession of property suspected to be proceeds of crime.

The charges alleged that between March 2017 and February 2022, Chama possessed seven flats in Jesmondine valued at K6.125 million.

Additionally, both were accused of engaging in transactions involving the proceeds of crime, and Bwalya faced a charge for failing to report a suspicious transaction to the Financial Intelligence Centre.

In a statement, DPP Phiri explained that the nolle prosequi was issued under Section 81(1) of the Criminal Procedure Code, allowing him to discontinue proceedings.

Phiri did not provide specific reasons for the decision, which often signifies insufficient evidence or considerations of public interest.

“This means that the state has decided not to pursue the case further at this time. This is not an acquittal, but it does mean that Mr. Bwalya and Ms. Chama are free from these particular charges unless new evidence emerges.”
