KABUSHI SEAT NULLIFIED
By Paul Shalala:
The Ndola High Court has nullified the election of Bowman Lusambo, as Kabushi Member of Parliament.
This is on account of violence, bribery, corruption and illegal practices, during the campaigns.
Lusaka High Court Judge, Edward Musona, who is sitting in Ndola, made the ruling today.
In his ruling, Justice Musona noted that Mr. Lusambo and his militia, called the Nato Forces, perpetuated widespread violence and intimidation in 4 out of the 8 wards of Kabushi constituency.
Justice Musona also said the violence, practiced by the Nato Forces, was in full view of Mr Lusambo and at no point did he stop or try to stop them.
Justice Musona said even the nickname Bulldozer for Mr. Lusambo was intimidating and it instilled fear in the Constituency during campaigns.
He said the petitioner gave enough evidence which warranted the nullification.
And on corruption, Justice Musona said evidence has shown that a lot of people received money which had been linked to Mr. Lusambo.
He also said Mr. Lusambo breached the Electoral laws on Polling Day when he visited Liyuni Primary School and produced the PF clenched fist symbol while voters where on the queue.
Justice Musona further revealed that the failure by Mr. Lusambo and the Patriotic Front to remove his campaign poster at Lubuto Secondary School before Polling Day was in breach of electoral laws because it was within 100 meters of the Polling Station.
And losing UPND Kabushi Parliamentary Candidate Bernard Kanengo said the Ndola High Court had vindicated his complaint of massive violence and corruption by Mr. Lusambo.
Mr. Kanengo said the people of Kabushi were denied an opportunity to freely elect their Member of Parliament.
Meanwhile, Mr. Lusambo has announced that he will soon file a notice of appeal in the Constitutional Court.
Mr. Lusambo said the fight for the people of Kabushi is not yet over and he is politically experienced to fight to the end.
