Court dismisses state’s application in Milingo Lungu’s case

By Hannock Kasama-The Lusaka Magistrate has dismissed the State’s application, demanding that Messrs Makebi Zulu Advocates must recuse themselves from representing Konkola Copper Mines -KCM Provisional Liquidator, MILINGO LUNGU in a case where he is charged with theft and money laundering involving 4 point four million Kwacha.

Lusaka Magistrate, FELIX KAOMA has ruled that the application lacks merit.

Magistrate KAOMA says pursuant to article 18 sub-article two of the Zambian Constitution the state failed to prove why Messrs Makebi Zulu cannot represent Mr. LUNGU in a criminal matter.

Mr. LUNGU is charged with theft and money laundering involving four point four million Kwacha.

In the first count, it is alleged that Mr. LUNGU 43, a legal practitioner, between May 22, 2019 and September 28, 2021 being a provisional liquidator of KCM allegedly stole 4 point four million, the property of KCM.

In count two, Mr. LUNGU is accused of having transferred 4 point four million Kwacha, knowing or having reasons to be believe that the same were proceeds of crime.
