ConCourt upholds election of Chinsali MP MUKOSA

The Constitutional Court has upheld the election of KALALWE MUKOSA as CHINSALI Central Member of Parliament.

Constitutional Court Deputy President ANNIE SITALI has declared Mr. MUKOSA duly elected after reversing the High Court’s verdict that nullified his election results.

Judge SITALI agreed with Mr. MUKOSA’s arguments that High Court Judge TIMOTHY KATANEKWA erred in law by nullifying his election results without evidence on allegations of malpractice  levelled against him.

Judge SITALI relied on Section 97 sub section two clause ‘A’ of the Electoral Process Act.

Mr. MUKOSA was represented by LEWIS NATHAN Advocates and TUTWA NGULUBE and Associates.

In November 2021, High Court Judge TIMOTHY KATANEKWA sitting in KASAMA nullified the election of Mr. MUKOSA following the petition by Mr. CHRISTOPHER MULENGA, an Independent candidate and CHARLES MUSANYA of the UPND.

Reacting to the judgment, Mr. MULENGA said he respects the court’s verdict though dissatisfied while Mr. MUSANYA echoed similar sentiments.

The two were represented by Lusaka Lawyer LAWRENCE CHIKUTA.

On the other hand Patriotic Front -PF- Acting President GIVEN LUBINDA said justice has prevailed over Mr. MUKOSA’s election.
