Mukata and Co-accused to open defense on November 29

November 29, 2017 has been set as the date UPND Chilanga MP Keith Mukata and his lover Charmaine Musonda will open their defense in the case where they are jointly charged with Murder.

The duo is appearing before High Court judge Susan Wanjelani for allegedly murdering Namakambwa Kalilakwenda, a security guard at Mukata’s law firm in Lusaka’s Rhodespark area.

And Mukata has u-turned on his earlier decision to not testify in his own defense, while his co-accused Musonda has maintained that she would remain silent.

Lawyer for the accused Lubinda Linyama had earlier said the defense was unable to proceed as they had received fresh instructions from the clients.

He said when the two were placed on defense, it was indicated that they will remain silent but proceed to call evidence.

“Upon further review of the circumstances,the first accused person has decided to give evidence on oath and will call witnesses while the A2 will remain silent,” Linyama submitted..

“We are therefore applying for an adjournment to conduct pre trial motions with the client. The defence proposes to open defence on 29th and 30th Nov 2017 and adds that the state has no objection to the application”

Deputy chief state advocate Marian Matandala Bah had no objection to the application.

Judge Susan Wanjelesani has since granted the application and adjourned the matter to 29th Nov 2017 at 09:00hrs for commencement of trial.
