			<content:encoded><![CDATA[<p>A Lusaka woman has challenged the High Court&#8217;s decision to relegate the custody of her two children to their father Kenneth Spooner, a British national.</p>
<p>Ms Zanneta Nyendwa has filed a notice of appeal in the Supreme Court.</p>
<p>The Lusaka High Court last week granted Mr Spooner custody of the children in contention, after a protracted legal suit.</p>
<p>Judge Elita Mwikisa held that Mr Spooner has demonstrated his capability to take care of the children both emotionally and financially.</p>
<p>She further held that being British Citizens, the children will have their interests best catered for if they continue living with their father in that country.</p>
<p>Judge Mwikisa refused to grant custody of the children to their Zambian mother Zanneta Nyendwa who is Mr Spooner’s partner.</p>
<p>She stated that Ms Nyendwa came to Zambia with the children on vacation, bearing in mind that she would restore the children to their father in Britain.</p>
<p>Judge Mwikisa noted that Ms Nyendwa has an option to go back to England and enjoy co-custody of the children with Mr Spooner as was the case before she came to Zambia.</p>
<p>She added that Ms Nyendwa is at liberty to stay in Zambia but merely visit her children in Britain.</p>
<p>The two children Delva Spooner and Caelan Spooner have been living in Zambia since 2008.</p>
<p>This is in a matter where Ms Nyendwa sought the court order to have custody of her children.</p>
<p>She further sought an order that Mr Spooner be granted supervised access to the children on the terms the court might deem fit.</p>
<p>Mr Spooner and Ms Nyendwa met in Britain in 2004 and were consequently in a non-marital relationship until 2008.</p>

<p>Ms. Namugala says a violent free country is a very conducive environment for investors to bring their money in.</p>
<p>In an interview with QFM, Ms. Namugala says the country&#8217;s environment needs to be conducive as Zambia is an emerging tourist destination.</p>
<p>She has since appealed to all peace loving Zambians to ensure that peace prevails at all times for the country economy to grow.</p>

<p>The Forum’s comments come in the wake of Vice-President Kunda’s recent observation that the failure to observe constitutionalism can ruin the country’s governance setup.</p>
<p>Citizens Forum executive secretary Simon Kabanda said instead of provoking people with statements which he does not mean, Vice-President Kunda should instead apologise to the Zambian people for the failed constitution.</p>
<p>“The Vice-President does not believe in the constitution because if he does, this time around we would have had a constitution that is in tune with the multi-party democracy we embraced in 1991.</p>
<p>But this is not the case because we are still using the one party state constitution,” said Kabanda in an interview.<br />
He said Vice-President Kunda did not believe in what he said on constutitionalism but merely said it for the sake of saying it.</p>
<p>“What he needs to do is just to humble himself and acknowledge that he is responsible for messing up our constitution-making process and apologise to the people,” Kabanda said.</p>
<p>Officiating at the Southern African Chief Justices Forum&#8217;s second Judges Colloquium at the Zambezi Sun Hotels on Thursday last week, Vice-President Kunda said the government attached great importance to constitutionalism and believed that it was key to democracy, human rights and the rule of law.</p>
<p>Vice-President Kunda said an American scholar, David Fellman, noted that those in political circles were not free to do anything they pleased in any manner they chose.</p>
<p>“They are bound to observe both limitations on power and the procedures which are set out in the supreme, constitutional law of the country. It may therefore, be said that the touchstone of constitutionalism is the concept of limited government under a higher law,&#8221; said Vice-President Kunda who was represented by local government minister Dr Brian Chituwo.</p>
<p>Vice-President Kunda said the government believed that constitutionalism was only a viable proposition.</p>

			<content:encoded><![CDATA[<p>President Rupiah Banda says that dialogue should be at the center of resolving any conflict that may occur in country.</p>
<p>President Banda says that the MMD government will continue to listen to divergent views from any sections of society so as to enhance participation in the governance of this country.</p>
<p>President Banda has further urged youths in the country to participate in the forth coming elections to turn up in large numbers to vote for their preferred candidate.</p>
<p>President Banda states that the government will ensure that it respects the independence of the electoral commission of Zambia.</p>
<p>He says that this will ensure that elections are credible for those that will be participating in the electoral process.</p>
<p>Meanwhile, President Rupiah Banda has urged Zambians to come together, regardless of political or social preferences, and celebrate the huge achievements the country has made.</p>
<p>In a TELEVIOSN message LAST NIGHT, ahead of African Freedom Day which falls today 25th May, President Rupiah Banda has also reinforced his commitment to building a better future for all Zambians.</p>

			<content:encoded><![CDATA[<p>Movement for Multiparty Democracy (MMD) member Nason Msoni has charged that revelations by former Ambassador Milton Phiri that President Banda is not qualified as Republican President should not be ignored.</p>
<p>Mr. Msoni says it is prudent for the MMD to seek for true and honest answers from President Banda who he says has several times admitted and stated that he was born in Zimbabwe.</p>
<p>The MMD member has added that what appears to be more serious is the allegation that both his parents hail from outside this country.</p>
<p>He says these allegations puts in danger the sovereignty and security of this country.</p>
<p>Mr. Msoni further says it is shocking that people who are not bonafide citizens of this country should cling to power and fight for the presidency of this country at all costs.</p>
<p>He has reiterated his call on the MMD to start searching for the alternative candidate adding that it is obvious that if anyone files an injunction against President Banda, it could complicate chances of the party in retaining power. </p>

			<content:encoded><![CDATA[<p>The citizen Forum has welcomed the move the Electoral Commission of Zambia (ECZ), the Zambia Police and the United Nations for Development Programmes (UNDP) for coming up with a programme aimed at training the security personnel ahead this year&#8217;s elections.</p>
<p>Citizen&#8217;s Forum executive secretary Simon Kabanda tells QFM news it is encouraging to note that the police service is committed to ensuring that the country holds violence free elections this year.</p>
<p>Mr. Kabanda however adds that the police should also ensure that they apply law fairly to all those involved the political arena irrespective of their political affiliations.</p>
<p>He adds that the police should start acting now by ensuring that political cadres are removed from bus stations and markets as a way of maintain peace in the country.</p>

<p>Reverend Masupa says whoever thinks president Banda is corrupt is free to report him the Anti Corruption Commission (ACC) and the Drug Enforcement Commission (DEC).</p>

<p>Hope for Human Rights executive director Smart Chanda says the international human rights law which is binding on all states dictates that all persons deprived of their liberty shall be treated with humanity and respect at all times.</p>
<p>Mr. Chanda explains that the situation at the Lusaka central prison is far beyond what is expected of a least developed nation.</p>
<p>He says prisoners are supposed to be provided with adequate cubic content of air, floor space, lighting and heating.</p>
<p>Mr. Chanda has therefore called on government to quickly move in and provide solutions to the problems being faced by inmates.<br />
