Man, 35, caged 33 yrs for defiling sisters

THE Ndola High Court has sentenced a 35-year-old man of Mushili Township to 33 years with hard labour for defiling two girls.

Ndola High Court Judge Muyinda Wanki sentenced Moses Chisupa, of no fixed abode in Ndola, to 17 years in prison with hard labour for defiling a 13-year-old grade five pupil and he was given 16 years imprisonment with hard labour for defiling an 11-year-old grade four pupil.

When passing sentence, Mr Justice Wanki said he had studied the records of the case proceedings at the Ndola Magistrate Court and found that the conviction was correct.

Facts of the case are that Chisupa, on dates between August 13 and August 16, 2007, defiled a girl aged 13.

In the second count, Chisupa, on the same dates, defiled a named girl aged 11.
According to the facts, the two sisters and another sibling were sent by their mother to sell bananas at Mushili Township market.

The victims narrated that they saw Chisupa and knew him as one of the people found at the market, and he got some bananas worth K10,000 from them.

Chisupa told the girls to collect their money from a shop within the market around 18:00 hours.

When the children got there, Chisupa opened the shop, locked them inside and told them that they were going to spend the night there.

The girls said Chisupa then had sex with one sister and then with another.
They said they screamed for help but that no one heard them, and they were defiled for four days.

Their mother reported to the police that her daughters had gone missing.
On the fourth day, after Chisupa unlocked the shop, the girls saw someone they knew.

They told him what had happened and he took them home. Chisupa had just given them K5,000.
Mr Justice Wanki said there was no miscarriage of justice during trial.

“I find that there was no misdirection or miscarriage of justice by the trial magistrate and I, therefore, uphold the conviction,” he said.

And a 27-year-old student of Ndola who was wanted by the police in 2008 in connection with the death of his 23-year-old girlfriend pleaded not guilty to murder yesterday.

The deceased was a student at NIEC School of Business Management Trust and was found dead in her room.

Mambwe Chizongwe pleaded not guilty to killing Sandra Mukuka.
Particulars of offence are that Chizongwe, on October 3, 2008, in Ndola murdered Mukuka.
Trial continues.
